The following Rules & Regulations apply specifically to Association #5 owners, residents and guests and are in addition to the Rules & Regulations which govern all of Friendly Valley and those governing the Recreational Association. They are also a supplement to this Association’s CC&R’s and Bylaws, and not a replacement thereof.
PETS There shall be a limit of two (2) pets (cat, dog, or bird) weighing not more than 30 lbs. each or one (1) pet over 30 lbs. in any household. Total weight of pets (fully grown) must not exceed 70 lbs. per household. Aggressive dogs, as “blacklisted” by Insurance Companies to prevent the high cost of liability claims, are not permitted. These breeds, or mixed breeds of the following include: Akitas, Mastiffs, Doberman Pinschers, German Shepherds, Pit Bulls, Rottweiler’s and Siberian Huskies. This provision has no effect upon these breeds already in residence, except that when pets in excess of the limit die, or otherwise permanently leave the household, they may not be replaced with any of the aggressive breeds mentioned above. PARKING OVERNIGHT Overnight parking is limited to two vehicles per home, one on the driveway (space permitting) and one in front of each owner’s own residence. All other vehicles will be subject to citations and fines. (Adopted April, 26, 2004)
COMMON DRIVEWAYS Parking in common driveways is limited to 15 minutes for loading and unloading only. (Adopted November 13, 2013)
CONTRACTOR / OWNER WORK RESTRICTIONS Contractors and Owners may only work on Units between the hours of 8 am to 5 pm Monday thru Friday and 9 am to 4 pm on Saturday and no work is permitted on Sundays. Exceptions by written permission by the Board of Directors. (Adopted September 3, 2015)
PENALTIES APPLICABLE TO VIOLATIONS The following penalty schedule shall apply to all violations of Association 5 CC&R's, Bylaws, and Rules & Regulations, at the Board's discretion. All monies for violation penalties are payable to Friendly Valley Association #5, to be deposited in the Association #5 operating account. The resident ("Resident") is responsible for the actions of his/her/their guests and also his/her/their employees (such as Contractors, laborers, household help etc.) . a. First infraction: A warning letter will be sent to resident.
b. Second infraction within a 12-month period of the first infraction: a notification letter will be sent to the resident and will include a penalty fine of $50.00 to be paid by the homeowner.
c. Third infraction and any infraction after that within the same 12-month period: a notification letter will be sent to the resident and will include an additional $100.00 fine, and each time another infraction occurs after the third infraction within the same 12 month period, an additional $100.00 fine will be levied.
d. If a fine is not paid by the due date stipulated in the notification letter, the resident’s gate card(s) shall be de-programmed and other Country Club privileges may be suspended. (Adopted October 1, 2015)
